A Legal Fight Over Race and Billions in Federal Contracts

|

A new federal lawsuit is reigniting the debate over race-based preferences — far beyond college campuses and DEI programs.

In this episode of The Miller Report: Real Clear Journalism, Maggie Miller and Ben Weingarten break down a legal challenge targeting the Small Business Administration and its long-standing practice of presuming certain racial and ethnic groups are “socially disadvantaged.” That designation unlocks access to billions of dollars in federal contracts, grants, and other government benefits.

The lawsuit, Revier v. Loeffler, argues that awarding federal opportunities based on race violates constitutional guarantees of equal protection and due process. But those in favor say it addresses historic discrimination.

We discuss how the 8(a) program works, whether race-based presumptions can survive constitutional scrutiny, and whether fraud and abuse can be addressed without dismantling the system altogether. If the plaintiffs succeed, the ruling could have far-reaching consequences — potentially reshaping federal contracting and ending affirmative-action-style programs across the government.
